What follows is the text of H.R.C. No. 50, a resolution passed and announced by the Texas legislature today.

CONCURRENT RESOLUTION
WHEREAS, The Tenth Amendment to the Constitution of the
United States reads as follows: “The powers not delegated to the
United States by the Constitution, nor prohibited by it to the
States, are reserved to the States respectively, or to the people”;
and
WHEREAS, The Tenth Amendment defines the total scope of
federal power as being that specifically granted by the
Constitution of the United States and no more; and
WHEREAS, The scope of power defined by the Tenth Amendment
means that the federal government was created by the states
specifically to be an agent of the states; and
WHEREAS, Today, in 2009, the states are demonstrably treated
as agents of the federal government; and
WHEREAS, Many federal laws are directly in violation of the
Tenth Amendment to the Constitution of the United States; and
WHEREAS, The Tenth Amendment assures that we, the people of
the United States of America and each sovereign state in the Union
of States, now have, and have always had, rights the federal
government may not usurp; and
WHEREAS, Section 4, Article IV, of the Constitution says,
“The United States shall guarantee to every State in this Union a
Republican Form of Government,” and the Ninth Amendment states that
“The enumeration in the Constitution, of certain rights, shall not
be construed to deny or disparage others retained by the people”;
and
WHEREAS, The United States Supreme Court has ruled in New
York v. United States, 112 S. Ct. 2408 (1992), that congress may not
simply commandeer the legislative and regulatory processes of the
states; and
WHEREAS, A number of proposals from previous administrations
and some now pending from the present administration and from
congress may further violate the Constitution of the United States;
now, therefore, be it
RESOLVED, That the 81st Legislature of the State of Texas
hereby claim sovereignty under the Tenth Amendment to the
Constitution of the United States over all powers not otherwise
enumerated and granted to the federal government by the
Constitution of the United States; and, be it further
RESOLVED, That this serve as notice and demand to the federal
government, as our agent, to cease and desist, effective
immediately, mandates that are beyond the scope of these
constitutionally delegated powers; and, be it further
RESOLVED, That all compulsory federal legislation that
directs states to comply under threat of civil or criminal
penalties or sanctions or that requires states to pass legislation
or lose federal funding be prohibited or repealed; and, be it
further
RESOLVED, That the Texas secretary of state forward official
copies of this resolution to the president of the United States, to
the speaker of the house of representatives and the president of the
senate of the United States Congress, and to all the members of the
Texas delegation to the congress with the request that this
resolution be officially entered in the Congressional Record as a
memorial to the Congress of the United States of America.

Awesome, just awesome. Leave it to Texas, that great state. Ok, let’s pay attention here to the Q and A. These questions are important because they show you how serious all of these people are about this. The question on the national guard for example is about how to have one if Texas does not accept funding from the national government. The answer the Governor gives is clear, not a problem, we have our own. Listen to the Q and A and let’s move on.

This is only two but there are more. The point is that Texas recognizes in our Federal Government the abrogation of State’s rights contrary to the Tenth Amendment of the Constitution. It reads:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

That’s clear and needs no elaboration from me. What is also clear is that Texas believes the United States government is overstepping this amendment. I agree. I propose that the current form of government in Washington is something our forefathers would have revolted against. That too much power is in the hands of people that are not in touch with the needs and desires of our states and citizens.

They are waking up ya’ll. And we should be too if you aren’t already. The implementation and morphing of Fusion Centers and Expanded Powers given to Homeland Security are frightening. The labeling by this same organization of fellow citizens as terrorist threats by their affiliations smacks of McCarthyism on a large scale. Once again the Republic of Texas has showed us the way. We’d better be paying attention when a State government is voicing it’s united concern about our Federal governments behavior. Especially when the behaviour is as far reaching as it is. Check out what Homeland security and the rest of your government have been up to. Amazon Glitch/Twitter Smackdown

Twitter once again flexed its not inconsiderable muscle last night as word spread that something was severely amiss at The internet giant, Amazon. Seems that Amazon has been quietly re-ordering it’s rankings of books. Books that were once ranked have mysteriously become unranked under a new system Amazon has been putting in place for nearly a week now. The upshot is that books that contain hetero or homosexual content are now unranked. While this does not prevent anyone from buying said books, this does prevent them from being placed in the most saleable positions on Amazon which in turn hurts sales of these books.

Books that are affected include Gore Vidal’s “The City and the Pillar”. Gore Vidal? Unranked? How about “The New Joy of Sex” which is an updated version of the 1970’s classic. The books that slip through the change in ranking defy comprehension as well. How about ” The Anarchists Cookbook” for one example. It’s pretty clear the new ranking system is selective concerning erotic content.

Twitter showed it’s muscle last night as the word on this so called “Glitch” spread. Shortly, there was a petition as well as many authors and bloggers writing to Amazon asking WTF? This is an amazing example of incredible response time to an issue courtesy of Twitter. If you want to know what’s going on this is clearly the place to be. Amazon will no doubt bend to public opinion and correct this “Glitch”. The real question is, what made them do it in the first place? What whispered in the ear of the Amazon people that this was a good idea? We may never know. The censorship of books for ANY reason is a direct assault on the 1st amendment and should be quashed as fast as possible.

Another AWOL

Here’s another guy steppin’ out AWOL from America’s media bullshit.

Everybody’s mad at Billy Bob Thornton right now but a little thought will ease your raging sensibilities.

Perhaps he’s just tired of the self absorbed pontificating media. How they apparently can’t (or won’t) follow instructions prior to an interview. They usually believe they are above the need to bow to requests. The video looks bad for Billy Bob. He seems to be sulking. Having attitude over an apparently trivial slight on the part of the unsuspecting and innocent radio jock @ Q fm. And then to call everyone in Canada “Mashed potatoes without gravy?” WTF is wrong with you Billy? Have you lost your mind? Are you off your meds? It’s not lookin’ too good for our resident hero right now.

First, was it a trivial slight? Did Thornton just over react? Think about yourself on your worst day. Would you have gotten angry for a trivial reason and then carried that anger on for over 7 long on the air minutes? Not me either. More likely is the long history of fucking with a media with average IQ of 50 constantly getting it wrong. More likely was the fact that once Thornton was in the chair they could throw the request he had made out the window. He was there to talk about his band and music. He apparently had made it clear to the station management: No talking about, not even a hint of my movie career. I’m here to talk about music. I’m not here to promote your station with the presence of Billy Bob the actor. Looked pretty bad didn’t it? Looked like the poor jock was just doin’ his job, doin’ what management told him too, just a poor schlock who didn’t get the message.

Doubt that very much. More likely was he got the message, he was told. He just decided that this little mention would be no harm. It was his show damnit and he was gonna talk about any damn thing he wanted. OK, fair enough, but be ready for the consequences of your actions. Take responsibility for them. Stand up and say, uh, yeah Billy Bob’s right. We were told but damn we screwed up and he has every right to be pissed.

Could I be wrong? Yeah, I could be but after seeing the long history of both Thornton and the media, my money’s on Thornton.

Senseless Death (Update)

Since the last post I have new information to impart to you.

The funeral will be tomorrow @ 11 am. For the Obit go to that section of this newspaper and type in “Jump” and it will give you the article. It does not link properly.

Senseless Death

A Father and Friend to many in our Village was senselessly gunned down early yesterday morning in Saline County Illinois near Harrisburg. Local sources say he was at a birthday celebration with extended family when the incident occurred.

Local authorities are not releasing the name yet and so neither will I. His family is well known in our small community and respected and that small dignity should be allowed throughout this ordeal. Local sources say three men suddenly showed up at the family gathering late at night. They were from the area and had had prior minor disagreements with the owner of the Saline county property.

The three men apparently just walked into the house during the brithday celebration and started mouthing off and generally being threatening. The owner and 2 others, including the victim, escorted the three from the residence and they apparently left without further incident.
Details are less clear about the number of times they returned but apparently on a second or even third trip back to the residence one of the troublemakers opened fire indiscriminately toward the house. Three people were standing out in front and 2 were shot. One was wounded and the other killed instantly with a shot to the head. The man’s 2 small children were witness to the shooting. CPR was performed on the victim until the ambulance arrived but he was pronounced dead at the scene. The other wounded man was treated at the hospital and released.

This sort of senseless violence is the kind that reminds all of us that it can happen anywhere any time. Apparently the level of altercation was minor and did not indicate that this kind of reaction was possible. To shoot indiscriminately into and at the house when two large families were present baffles the mind. I knew the victim as a child playing sandlot ball together and what’s more know the victim’s family fairly well. He was not a man that would have put his family or friends at risk had there been any indication that it was a possibility.

One man is in custody in Harrisburg and his identification is being witheld as are the identities of 2 other men yet to be apprehended. The police still have not found the gun.

Arrangements are still pending but as soon as I have them I will post them. May God bless and keep his family through this ordeal.

Ron Paul is Right

Ron Paul is right about many things, not the least of which is the recent faulty reasoning behind the AIG bailout. I am furious that bonuses were paid out to individuals , some amounts were in the Millions of dollars – 165 million to be exact. Wow folks, that money is yours and it will never be recovered. As Iowa Senator John Grassley said on Monday while talking to the radio audience of WMT in Cedar Rapids:

“I suggest, you know, obviously, maybe they ought to be removed,” Grassley said. “But I would suggest the first thing that would make me feel a little bit better toward them if they’d follow the Japanese example and come before the American people and take that deep bow and say, I’m sorry, and then either do one of two things: resign or go commit suicide.”

His spokesperson had to explain to the media that the Senator wasn’t actually calling for the CEO’s to commit suicide but rather to take responsibility for their actions. I think he was calling for them to kill themselves for it is the only honorable thing left for them to do.

After coming to Congress with their hats in their hands they then make a mockery of the whole thing by:

a. Immediately making it clear that they would need more—much more.

b. Paying out bonuses to people responsible for getting them into this mess in the first place.

Fox News reported on their Fox Friends program this morning that these bonuses were retention bonuses and that after receiving them many of the people resigned from their jobs on Friday. WHAT!!!!!???? The whole thrust of the argument for paying these bonuses was that they were mandated by contractual obligations. So, The CEO’S meet their contractual obligations and then the people receiving this money are not held to their end of the freakin‘ deal? ARE YOU KIDDING ME?

This is a standout example of what Senator Paul has been saying all along; Get Government out of the business of business. This total screw up is less an example of corporate greed and more an example of governmental ineptitude. The rush to “Fix” the economic crisis overrode common sense on Capitol Hill and now their lack of foresight or even common business sense is there for all the world to see.

Do you see now America? Do You? These are the same individuals that run your day to day business with your money. These are the same people that claim expert status when telling you that they need to be running the private sector. The free market system was DESIGNED to run without government interference, hence, it is only logical that interference in the free market system by the government is anti-thetical to the whole damn process. For God’s sake people the Federal Reserve isn’t even a part of the Federal Government yet we the people are in debt to that institution for over a trillion dollars. The dollar is worth 3 cents today. If your stock market portfolio performed like that you would have had a contract out on your broker.

Listen to what Senator Paul says about this in an off the cuff interview in the Senate House:

Ron Paul is right. The bailout does nothing for you and I but worsen the situation. It is time: not to stand up to your government, but to be the government mandated by your forefathers in the Constitution of the Republic of the United States of America. The whole world is watching to see what we do America. What are you going to do? Anything at all? Or has greed so overrun society that we would rather the elected politicians try and buy us a little more party time? A little more time to try and make this nightmare go away?

It’s not going away without drastic measures America. Either you take drastic action or they will. Either way it’s going to be a tough road. But what do you want? Enslavement to a government of indecision and poor management-not only of your money but of your children’s future in this world, or to take back control of an out of control mega machine on a path to destruction that will eventually bow the knee to World Opinion on everything. I know I did not grow up in an America that depended on world opinion to shape its policy-domestic or foreign. And I did not grow up in an America that was cowardly. Here is a good first step:

Follow the instructions this video asks of you. By the way, please note over 2 and 1/2 million hits on this video. You are not alone – start acting like it.

An open letter to Former President George Bush

Dear former President Bush,

Reading about the sentence passed on the man that threw a shoe at you in December brought to mind a puppet state in need of validation – I speak , of course, of Iraq. The sentence passed on Muntadhar al-Zeidi, a Journalist in his nation, was the minimum sentence allowed by the laws of the land. Still, this journalist recieved 3 years in prison for his deed.

Now, I understand that it is necessary to validate the exisitence of the new government and to uphold the laws of the land in regard to visiting dignitaries. However, my guess is that you could probably list a lot of people that would like to throw more than a shoe at you. Judging from the video, you did a great job of dodging the leather missile and brought his effort to naught. So, no harm to your person and a notch up on the respect meter from those of us that appreciate an athletic leader.

But, our friends in the middle east (I use the term loosely), are somewhat incensed by the sentence pronounced. They see it as another example of American Colonialism at it’s worst. This is doing us no favors in world opinion. Also, this man is a Journalist in his country. He has a bit more cred than the average Joe (or Achmed if you prefer). His expression of indignity at the manipulations and destruction of his country seems rather muted in retrospect. In His country this was a sign of disrespect, much like when we put the middle finger up at you when you are on TV.

So, former President Bush, cut the guy some slack. Let’s make the time fit the crime. As an alcoholic myself I can testify that a lot worse and more deadly things than shoes have been thrown at me and my bet is you can testify to that as well. All your official spokesperson’s protestations aside, you could easily defuse this with a phone call and ask that this man’s sentence be commuted to a suspended sentence that is reinforced only if he commits such an act again. This would let him continue to be a journalist in his country and defuse some of the resentment.

In other words, no big deal Mr. Bush.
